Biden’s Vax Mandate Back, States Petition Supremes

A federal judge reinstated President Biden’s mandate for vaccinations for private businesses. In response, 27 states have asked Supreme Court Justice Brett Kavanaugh to delay the mandate as the full Court considers the mandate’s constitutionality.

The mandate is slated to go into effect on January 4, 2022.

Last month, the states filed a lawsuit with the Supreme Court saying the executive order overstepped the Administration’s authority.

The 6th U.S. Court of Appeals in Cincinnati reversed an injunction from the 5th Circuit Court against implementation of the vaccine mandate on Friday, December 17. The court said that the Occupational Safety and Health Administration (OSHA) had historical precedent to protect the nation’s workers from the virus.

The following Monday, the states petitioned Justice Kavanaugh.

OSHA said in light of “any uncertainty created” by the legal activity, it would not issue citations for noncompliance before January 10.
