Millions of workers are expected to be affected by new overtime rule in December

When the Overtime Final Rule takes effect December 1,2016, estimates are 4.2 million workers will need to be reclassified as their employers comply with the new labor standard.

The Overtime Final Rule aims to more easily identify workers, via a salary level test, who are truly exempt vs. entitled to overtime protections through the FLSA (Fair Labor Standards Act). 4.2 Million U.S. white collar EAP, or executive, administrative and professional workers, are expected to be reclassified or receive salary increases.

"The Overtime Final Rule focuses on increasing the salary level needed for EAP workers to be exempt. In addition to the standard salary level doubling from more than $23,000 to more than $47,000, there's another threshold that must be met for highly compensated employees. Those employees must pass a minimal duties test and essentially the salary level is bumped from $100,000 to $134,000 annually," says Avitus Group Director of Human Resources & Risk Management Ryan Braley. "There are many factors to consider with this new regulation and Avitus Group makes sure our clients are trained so that they can be in compliance come December 1st."
